Construction Defect

A construction defect can be defined as any defect in the design or construction of any improvement to real property that causes any damages to (including the loss of use of), real or personal property. Defects can range from structural issues such as foundation problems to leaky roofs or windows, to simple ones such as dry wall or an incorrect paint color. Construction defects can be those that are readily apparent or those that aren’t obvious and lay dormant for some time until discovered due to some act, like a rain storm revealing a leaky roof. Regardless of the cause, construction defects can cost a great deal of money and create multiple legal difficulties. Construction defect laws can be very complex and generally involve several different parties and often the matter will involve actions against insurers in one capacity or another.
